Engagements
Strategic Counsel, Defined Before We Begin
How We Work
FDP Law is strategic counsel, not a routine litigation practice.
Most of our work happens upstream of court: protecting intellectual property and trade secrets, structuring agreements and transactions, developing AI and governance frameworks, and advising businesses where the legal decision and the business decision cannot sensibly be separated.
We do not accept routine local disputes, municipal matters, or engagements centered on day-to-day court appearances and procedural administration. When a state or local proceeding intersects with a matter on which we are advising, FDP Law may serve as strategic counsel while appropriate local counsel handles jurisdiction-specific procedure.
Litigation is sometimes necessary. It is rarely the objective.
A lawsuit consumes management attention, capital, time and opportunity. Our first question is what outcome actually matters to the business, where the leverage lies, and whether that outcome can be reached before the dispute becomes the business.
The objective is to protect the company, preserve its options, solve the problem and get management back to building.
Ongoing Counsel Engagements
We define the engagement before we begin. Fees are structured around the responsibility FDP Law is taking on, the complexity of the matter, and the level of ongoing involvement required, not simply the amount of lawyer time consumed.
| Intellectual Property | Ongoing counsel, or a defined protection / program engagement |
| Artificial Intelligence | Ongoing counsel, or a defined governance engagement |
| Digital Assets | Defined engagement based on structure, activity, and jurisdictions |
| Compliance & Governance | Ongoing counsel based on organizational and regulatory scope |
| Transaction Facilitation | Defined by the transaction and the responsibility involved |
| Business Advisement | Ongoing counsel |
ONGOING BUSINESS COUNSEL
Ongoing counsel engagements are structured around the breadth of responsibility assumed, expected availability, the complexity of the business, and the number of active matters involved. Engagement scope and fees are agreed before work begins.
How Engagements Are Structured
Every engagement is defined around the responsibility FDP Law is assuming, the complexity and exposure involved, and the level of continuing involvement required.
- Responsibility scope of the matter and how much ownership sits with FDP Law
- Complexity business, legal, and technical complexity
- Exposure regulatory, financial, and commercial stakes
- Breadth number of matters, entities, agreements, or transactions involved
- Availability expected access and response requirements
- Operational Footprint company size, stage, and jurisdictions
- Specialized Demands technical, industry, or interdisciplinary requirements
FDP Law is generally retained where the value of the engagement lies in judgment, structure, and strategy, not routine legal process.
